Course Description:
This course has been approved by the Education Subcommittee of the Vermont Real Estate Commission for four (4) clock hours for activating or renewing a real estate license in Vermont. This course satisfies the Mandatory Course requirement for renewal of Vermont real estate licenses in 2010. Level of Study: Intermediate, appropriate for Brokers and Salespersons
LEARNING OBJECTIVES
- To review and discuss the new and existing rules relating to brokerage practices
- To review and discuss the regulatory aspects of buyer brokerage
- To reinforce understanding of the rules of practice by analysis of practical examples, case studies, and/or hypothetical situations
METHODS OF INSTRUCTION
Lectures review the Vermont Real Estate Commission rules relating to Conduct of Licensees (Part 4 of the Rules) including both existing rules and rules changed or added effective April 15, 2008. Emphasis is given to a review and discussion of the regulatory aspects of buyer brokerage. This is NOT a course on buyer broker compensation or liability.
The lecture portion of the course will last approximately 2.5 hours including time for examples and some class discussion. The final 1.5 hours is devoted to a review and analysis of six (6) specific hypotheticals emphasizing regulatory aspects of buyer brokerage, but also including other issues such as advertising, avoiding dual agency, basic disclosure requirements, unlicensed assistants, using the new mandatory consumer disclosure form and rule, and avoiding prohibited practices such as designated brokerage and transactional brokerage.
The instructor will encourage class participation throughout the course. This Course is the mandatory course of the 2010 renewal of licenses and therefore is equally appropriate for the beginner as well as the experienced licensee. This Course is suited for private offerings to small groups and single firms, as well as larger groups. In the smaller offerings, classroom style instruction will be in roundtable format.
Audio/Visual Aids will not be used.
COURSE CONTENT
1st Hour: Introduction; summary of course objectives and purposes; scope of the rules and permitted agency; the new mandatory consumer disclosure form;
2nd Hour: Other mandatory disclosures required by the rules; avoiding dual agency;
3rd Hour: Other areas of practice changed and/or clarified by the new rules; begin discussion of Hypotheticals;
4th Hour: Discussion of remaining Hypotheticals, the Case Study, and General Discussion Items; Closing & Evaluation
COURSE MATERIALS
Participants receive a comprehensive course outline and workbook containing six (6) hypotheticals, one (1) case study, and several general discussion items. Participants also receive two booklets: (1) Selected Vermont Rules Relating to Real Estate Agents containing a seven page comprehensive index and a seventeen page easy to read reprint of the relevant Vermont rules; and (2) Summary of Changes to the Vermont Rules for Real Estate Brokers and Salespersons, Effective April 15, 2008, a four page handout containing rules changes by topic. This handout is suitable for attachment the licensee’s current copy of the laws and rules. There is no separate textbook.
INSTRUCTOR
Instructor: Randall F. Mayhew, Vermont Attorney, Adjunct Professor of Law at Vermont Law School, longtime instructor of real estate professionals and law students regarding real estate transactions, and practicing attorney dealing with many real estate transactions.
