    Course Description:

    This course has been approved by the Education Subcommittee of the Vermont Real Estate Commission for four (4) clock hours for activating or renewing a real estate license in Vermont.  This course satisfies the Mandatory Course requirement for renewal of Vermont real estate licenses in 2010.  Level of Study: Intermediate, appropriate for Brokers and Salespersons


    LEARNING OBJECTIVES

    • To review and discuss the new and existing rules relating to brokerage practices
    • To review and discuss the regulatory aspects of buyer brokerage
    • To reinforce understanding of the rules of practice by analysis of practical examples, case studies, and/or hypothetical situations


    METHODS OF INSTRUCTION

    Lectures review the Vermont Real Estate Commission rules relating to Conduct of Licensees (Part 4 of the Rules) including both existing rules and rules changed or added effective April 15, 2008. Emphasis is given to a review and discussion of the regulatory aspects of buyer brokerage. This is NOT a course on buyer broker compensation or liability. 

    The lecture portion of the course will last approximately 2.5 hours including time for examples and some class discussion. The final 1.5 hours is devoted to a review and analysis of six (6) specific hypotheticals emphasizing regulatory aspects of buyer brokerage, but also including other issues such as advertising, avoiding dual agency, basic disclosure requirements, unlicensed assistants, using the new mandatory consumer disclosure form and rule, and avoiding prohibited practices such as designated brokerage and transactional brokerage.  

    The instructor will encourage class participation throughout the course. This Course is the mandatory course of the 2010 renewal of licenses and therefore is equally appropriate for the beginner as well as the experienced licensee. This Course is suited for private offerings to small groups and single firms, as well as larger groups.  In the smaller offerings, classroom style instruction will be in roundtable format. 

    Audio/Visual Aids will not be used. 


    COURSE CONTENT

    1st Hour:  Introduction; summary of course objectives and purposes; scope of the rules and permitted agency; the new mandatory consumer disclosure form; 

    2nd Hour:  Other mandatory disclosures required by the rules; avoiding dual agency; 

    3rd Hour: Other areas of practice changed and/or clarified by the new rules; begin discussion of Hypotheticals; 

    4th Hour: Discussion of remaining Hypotheticals, the Case Study, and General Discussion Items; Closing & Evaluation


    COURSE MATERIALS

    Participants receive a comprehensive course outline and workbook containing six (6) hypotheticals, one (1) case study, and several general discussion items.  Participants also receive two booklets: (1) Selected Vermont Rules Relating to Real Estate Agents containing a seven page comprehensive index and a seventeen page easy to read reprint of the relevant Vermont rules; and (2) Summary of Changes to the Vermont Rules for Real Estate Brokers and Salespersons, Effective April 15, 2008, a four page handout containing rules changes by topic.  This handout is suitable for attachment the licensee’s current copy of the laws and rules.  There is no separate textbook.

    VERMONT REAL ESTATE BUYER BROKER SERIES – PART 1

    FROM INITIAL CONTACT TO HIRING OF THE REAL ESTATE BROKERAGE FIRM

     

    This course has been approved by the Education Subcommittee of the Vermont Real Estate Commission for four (4) clock hours for activating or renewing a real estate license in Vermont.  This is an elective continuing education course.  Level of Study: Intermediate, appropriate for Brokers and Salespersons

     

    LEARNING OBJECTIVES

    * To understand the legal requirements for buyer representation in Vermont

    * To identify and properly manage conflicts of interest

    * To create buyer service agreements which reflect the needs of a particular buyer-client

     

    METHODS OF INSTRUCTION

    Initial lectures cover the statutory framework for representing real estate buyers in Vermont, anticipating conflicts of interest, and understanding and disclosing the firm’s agency policies, including the analysis of sample policy statements.  Next the participants are given a generalized view of what is expected of a buyer broker in theory, followed immediately by a survey where they are asked to consider whether any of over 40 specific items fall within the scope of a buyer brokers duties.  This segment is generally held in group discussion format.  After break, there are two segments of lecture material mixed with analysis and discussion of sample documents.  The first segment emphasizes the buyer service agreement and the second emphasizes the initial interview and completion of a target property profile.  The final 45 minutes of the course switches to the review, development, and discussion of various hypothetical questions which are designed to be resolved and/or analyzed by participants.  The outline for this course is somewhat unique in that it includes 25 text boxes which are set up in “presentation style” both to assist the participant in following the instructor and to provide more detailed information when necessary.  This course is appropriate for the intermediate as well as the experienced licensee.  Another unique feature of this course is that it is co-taught by an attorney and a licensee.  The licensee has over 15 years of exclusive buyer broker experience.  This course is suited for private offerings to small groups and single firms, as well as larger groups.  In the smaller offerings, classroom style instruction will be in roundtable format.  Audio/Visual Aids not used. 

     

    COURSE CONTENT

    This course is designed to be the first in a series of courses on the subject of buyer representation.  This course covers the time frame between initial contact with the client to the point where the firm is hired to perform brokerage service.

     Hour 1:  Introduction, Vermont Statutory Framework for Representing Buyers, Anticipating Conflicts of Interest, Understanding the Firm’s Agency Policies;  Hour 2:  Disclosing the Firm’s Agency Policies, So, What Does a Buyer Broker Do?  Student Survey Regarding Buyer Broker Duties,  Begin Buyer Service Agreements in Vermont;  Hour 3:  Continue Buyer Service Agreements in Vermont, Begin The Initial Meeting with the Prospective Buyer Client;  Hour 4:  Continue The Initial Meeting with the Prospective Buyer Client, The Decision to Accept the Prospective Buyer as a Client (Hypotheticals), and Issues Regarding the Buyer Service Agreement (Hypotheticals)

    Participants receive a comprehensive bound course outline containing 25 “presentation style” text boxes and 11 hypotheticals.  The appendices include a sample Short Form contract, sample policy disclosures, a sample format for creating a target property profile, and other matters.  There is no separate textbook.

    This course has been approved by the Education Subcommittee of the Vermont Real Estate Commission for two (2) clock hours for activating or renewing a real estate license in Vermont. 
     
    Level of Study: Intermediate, appropriate for Brokers and Salespersons


    LEARNING OBJECTIVES 
    • To review general theories regarding broker due diligence
    • To understand the broker due diligence requirements in Vermont
    • To explore how broker due diligence is applied in Vermont by study of examples


    METHODS OF INSTRUCTION

    Lectures first review the general theories of due diligence for real estate brokers, taken in large part from the works of a respected legal scholar in the law of real estate brokers.  Thereafter the lectures expand to cover Vermont’s particular requirements as set forth in the rules and regulations of the Vermont Real Estate Commission and as established by several Vermont Supreme Court cases. 

    Materials include a special informal analysis by Randy Mayhew, Esq. regarding the question of whether due diligence standards include the duty to obtain documents evidencing the seller’s source of title.  The course then turns to a punch list of procedures to follow in order to obtain the documents evidencing title and to learn of title exceptions.  

    The primary emphasis of instruction, however, is the last 75 minutes allotted to discussion of six (6) separate examples designed to promote discussion among participants as to what is required in specific, practical cases which frequently arise in Vermont practice.  Additionally, participants will be encouraged to cite other examples from their own experiences.
      

    This Course is appropriate for the beginner as well as the experienced licensee.  This Course is suited for private offerings to small groups and single firms, as well as larger groups.  In the smaller offerings, classroom style instruction will be in roundtable format.

    Participants receive a brief course outline.  A ten page booklet containing course materials mentioned in the outline is attached to the outline.  There is no separate textbook.

    INSTRUCTOR

    Randall F. Mayhew, Vermont Attorney, Adjunct Professor of Law at Vermont Law School, longtime instructor of real estate professionals and law students regarding real estate transactions, and practicing attorney dealing with real estate transactions.

    From time to time, Mr. Mayhew may be joined by Elizabeth Merrill, GRI, CRS, and ABR, over 30 years experience as an active real estate broker and former member of the Vermont Real Estate Commission, serving as its Chair for two years.
